It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both parties in writing.

The parties are hereby known as the Wedding Photographer (hereinafter referred to as the "Photographer") and the Bride and groom (hereinafter referred to as the "Couple").

This contract for wedding photography services is effective and binding from the date it is signed by both parties and the deposit having cleared the Couple's account.

The Product

The Photographer agrees to be in attendance at the agreed times on the wedding date above and to take the photographs during the day.

The photographer agrees that the couple will be provided with photographic services and products as detailed in the appropriate package description below, selected by the couple.

Prints will be provided as 6"x4"s

The Prints will have a:

Gloss finish or

Matte finish.

You do not receive any proofs or low resolution CD.

You get to keep EVERY photo.

You get to keep EVERY negative.

You get to keep EVERY JPEG supplied on CD with reproduction rights.

Around 500 images captured, as many as possible.

The Price

This contract is for the package indicated above.

The couple agree that they are liable to pay the full cost of the wedding package purchased.

A 10% deposit will be paid to secure the date. All deposits are non-refundable even if the date is changed or if the wedding becomes cancelled for any reason.

All prices quoted at the time of booking will be honoured, regardless of the actual booking date. Prices in force at time of booking are those written on this contract, which is accepted by the signature of both parties and the 10% deposit paid.

Schedule of Payments

The remaining balance will be paid in two stages, 40% and the remaining 50% on the dates agreed herein. .

Collection of Photographs

The photographs, album and CD will be ready within 72 hours. They will be delivered to an agreed location at the couple’s convenience.

Force Majeure or Act of God

The due diligence of this contract is subject to alteration or cancellation by the Photographer owing to any cause beyond his control.

In the unlikely event of total or part photographic failure, due to injury or sickness beyond the Photographer's control, the photographer’s liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected.

This limitation on liability shall also apply in the event that the photographic materials are damaged in processing, lost through camera malfunction, or otherwise lost or damaged without fault of the part of the photographer. Clients agree that an entire wedding cannot be replicated, re-enacted or repeated for the purpose of a re-shoot and limits photographer's liability to the amount paid under this contract.

Cancellation

If the Photographer has to cancel this contract for reasons beyond his control, for example including but not limited to death, injury or sickness, the Photographer?s liability shall be limited to a full refund of all monies paid, including the 10% deposit.

The client may cancel this contract at any time and their liability shall be limited to the moneys paid up to the date on cancelation.

Complaints Procedure

In the unexpected case of complaint the couple should raise the complaint in writing within 21 days from the date of receipt of the photos. The Photographer will respond to any complaints within 24 hours.

Privacy

The Photographer will store your name and address. These details will not be made available to any individual or organization at any time.

Copyright and Model Release

We the Couple give the Photographer the absolute right to copyright and use of the photograph(s) taken at our wedding and any other reproduction or adaptations thereof, in whole or in part, alone or in composite or altered form, or in conjunction with any wording or other photographic drawings, for advertising, publicity, editorial or any other purpose including use on the internet.

We the couple understand that we do not own the copyright of the photograph(s), and that we waive any right to inspect or approve the finished use of the photograph(s) and that the copyright of the photograph(s) belongs to the above-named photographer as per the United Kingdom Copyright Act 1988.

License to Reprint and redistribute

When the high resolution images on DVD are given to the couple, I the Photographer give the couple license and right to reprint those images and distribute for personal use. They may not be sold or used in any commercial publication or website without the photographers consent.

Artistic License

The Photographer shall strive to accommodate reasonable requests in regard to poses used, locations used and group shots taken. The Photographer shall be granted artistic license in relation to the poses photographed, the location used and the group shots taken. Due to the vagaries of the weather and the willingness of the subjects it may not be possible to capture all the photographs requested.

It is understood and agreed that no other photographer will be allowed to photograph or take pictures at the wedding while the photographer is working.

Signatories

We, the undersigned parties, hereby warrant that we are competent to contract in our own names. We confirm that we have read the herein agreement prior to its execution and that we are fully familiar with the contents thereof. This agreement shall be binding upon us and we certify that we have received a complete copy of this agreement with all blank lines completed.
